Terms of service

  1. Madi Bowman sells original works of art by Madeline Grace Bowman through its website https://www.madibowman.com.  By using this site, you agree to the Terms and Conditions, set forth below. 

  2. Color:  We have made commercially reasonable efforts to show the colors of original works of art accurately.  Because your monitor may show colors differently, Madi Bowman is not responsible for color accuracy.  Your sole remedy for any perceived color inconsistencies is to return the painting for store credit.

  3. Ownership of Content - Intellectual Property: The Copyright Laws of the United States protect the materials on this site. Madi Bowman is the exclusive owner of the intellectual property rights to all photos, images, text, videos and any other material or content included on https://www.madibowman.com.  

  4. Social Media Content Sharing: Madi Bowman authorizes you to share content on social media linked to this site.

  5. Third-Party Services:  We use third-party services, applications or websites, that make available their content and services. When you access those third-party services, applications or websites, you are bound by the terms and policies of the third party.

  6. Purchasing Policy: Madi Bowman will verify by email both your order and shipment and forward you a delivery tracking number if applicable.

  7. Payments:  Payments are made through PayPal or directly to me electronically.  Processing of payments is subject to the third party’s Terms of Service and Privacy Policy.  Charges for state and local sales tax, and shipping will be applied at checkout and are the sole responsibility of the buyer.  Full payment, including shipping and applicable sales tax is due upon order

  8. Customer Complaints:  You must notify me in writing within three days of receiving your order of any issues or waive any remedies under the law at contact@madibowman.com.   

  1. Limitation of Liability: Madi Bowman's liability will not exceed the total amount paid for the artwork, and your sole remedy is limited to the amount you paid for the artwork.

  2. Governing Law: California law exclusively governs the terms and conditions of this Agreement.  

  3. Dispute Resolution:  Any controversy or claim arising out of or relating to this contract, or the breach thereof, must be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
